SD STEP 2

Prepare and issue the NSD and request a written corrective action plan.

In Step #2, the sponsoring organization needs to prepare the formal response for the Serious Deficiency. These include:

1. Prepare the Notice of Serious Deficiency (NSD).

2. Issue the Notice of Serious Deficiency.

3. Request a written Corrective Action Plan (CAP).

1. Prepare the NSD

The NSD must list the person(s) responsible, what the Serious Deficiency is and the corresponding CACFP regulation, policy or Instruction. It must also list the corrective action requested along with a deadline and instructions for submitting the CAP. It must identify the key staff responsible for the noncompliance and the person licensed to provide care.

2. Issue the NSD

This notice must be sent by certified mail return receipt, email or fax. It must describe the action taken or proposed by the sponsoring organization with regards to the day care home’s participation, and must also be sent to the State Agency at the same time it is sent to the day care home provider.

3. Request written CAP

The CAP  must be clearly written, easy to understand and related to program operation. It must be related to CACFP regulations or State policy and provide an opportunity for the day care home to resolve the serious deficiency. The request for the CAP must be realistic and allow adequate time to correct the noncompliance  as soon as possible (not to exceed 30 calendar days).

Lastly, the sponsoring organization may conduct a follow up visit to verify that the corrective action has been completed within the 30 calendar days.
