SD STEP 6
(A) If termination and disqualification are upheld, issue the NFTD, or (B) if termination and disqualification are overturned, issue the NTD.
The final step is Step #6, where there are two outcomes as well.
If the proposed termination and disqualification are upheld, the appeals officer determined that the sponsoring organization followed all of the requirements of the serious deficiency process. The sponsoring organization issues the NFTD. If the proposed termination and disqualification are overturned, the appeals officer determined that the sponsoring organization did not follow all of the requirements of the serious deficiency process. The sponsoring organization issues a NTD as referenced in Step 4 above.
Either way, the decision is issued in writing and it is the final administrative decision.
