SD STEP 4

(A) Accept the correction action and issue the NTD, or
(B) Deny the corrective action and issue the NPTD and the sponsoring organization’s appeal procedures.

For Step #4, a sponsoring organization has two choices. One is to accept the CAP and issue the NTD. The second choice is to deny the CAP and issue NPTD, including the sponsoring organization’s appeal procedures.

 

If the CAP is accepted, the day care home provider:

Next, the sponsoring organization will need to Issue the NTD. The serious deficiency process will end here as long as the day care home provider continues with their processes and procedures implementation and the noncompliance is fully and permanently corrected. However, if the noncompliance returns or the CAP is not accepted, the serious deficiency process will continue at the step below and the day care home ‘s agreement could possibly be terminated and the day care home and responsible persons disqualified.

However, if the sponsoring organization does not accept the CAP,  the sponsoring organization must deny the CAP and issue the NPTD. The CAP should be denied when:

  • It is not submitted by the deadline date, and no request for an extension was made and approved.
  • It does not address the actual noncompliance  or serious deficiency.
  • It is not all-inclusive of the corrective action requirements.
  • Supporting  documentation was not submitted that demonstrates full and permanent correction of the serious deficiency.
  • When the results from the follow-up visit indicate the serious deficiency remains and the submitted CAP has not been implemented.
